When facing a divorce, both parents may feel certain they’re the most suitable caregiver for their child. But how does the court make that difficult decision? What factors influence the court's perspective on who is the “𝙗𝙚𝙩𝙩𝙚𝙧” parent? Is it about who’s consistently cared for the child or more about future stability and the support each parent can provide? Courts look at evidence of past caregiving, considering if a parent has been involved in daily responsibilities and shown consistent care. They examine the emotional bond each parent shares with the child, especially if one parent has been the primary caregiver since birth. What’s next also matters. A parent’s vision for a stable home life and structured routines can make a strong impression. At the same time, courts value a parent’s willingness to encourage the child’s relationship with the other parent, signalling a commitment to the child’s emotional well-being and reducing conflict. When the child is mature enough, courts may even consider their wishes, but this raises its own questions: does this put unnecessary pressure on the child, or does it provide them a voice in their future?
